Clogging of parking area on high court premises: Has Chandigarh prepared a disaster management plan, HC asks admin

Taking a suo motu action over the clogging of the parking area on its premises following heavy rains, the Punjab and Haryana High Court has asked the UT administration whether it has prepared a disaster management plan.

Earlier, the members of the High Court Bar Association following recent heavy rainfall had intimated it that there is clogging of the lanes leading up to the court and in the reserved parking area.

During the resumed hearing of the matter, Anil Mehta, Senior Standing Counsel, Chandigarh with advocate Jaiveer Chandail, waived service of notice on behalf of the respondent, Chandigarh Administration.

The division Bench of Justice Sureshwar Thakur and Justice Sudeepti Sharma, directed the UT counsels to ensure that on the subsequent date of hearing, inputs are made available to the court for discerning, which are “whether the administration concerned has prepared a disaster management plan in respect of Chandigarh”, and “whether adequate sum of money has been assigned by the authorities concerned, for ensuring that the remedial measures, as echoed, in the said disaster management plan, are thereby put to the requisite remedial actions”.

The high court has also asked the administration to mention whether, as such the action takings as have been made, on the suggestions made in the disaster management plan are complete or incomplete, and, the reasons for non-takings of complete actions.

The Bench further asked the UT administration that whether it has failed to take notice of the fact that there is immense clogging of water in the premises of the high court, which ultimately deters this court for promptly discharging its duties.

The high court has also asked the UT administration whether the latter has ensured that there is adequate sanitary facilities provided in the premises of the court.

Ordering further to list the matter on December 8, the Bench said that a copy of this order be supplied to the President of the Bar Association, who may also purvey his suggestions in the matter.
