The Punjab and Haryana High Court has stayed further proceedings against former Punjab MLA Sucha Singh Chhotepur before the trial court under sections 188 of the Indian Penal Code (IPC) and Disaster Management Act.
It was alleged in the First Information Report (FIR) that Chhotepur, who was the candidate of Shiromani Akali Dal in Batala constituency in the February 2022 Punjab assembly elections, conducted a road show which was against the mandate of Election Commission.
The former tourism minister on February 9 had moved the high court for quashing the FIR against him under section 188 (Disobedience to order duly promulgated by public servant) of IPC and section 51 of Disaster Management Act, 2005, at Civil Lines police station, Batala, in Gurdaspur district.
As per the police, the FIR was registered on the complaint of Tejinder Singh VST (Video Surveillance Team). It was alleged that he committed an offence under section 188 IPC, 51 Disaster Management Act, 2005.
The counsel for Chhotepur, advocate Bikramjit Singh Baath, argued before the HC that the FIR deserves to be quashed as the same has been registered in violation of 195 (1) (a) of the Code of Criminal Procedure.
The bench of Justice Sudhir Mittal said that further proceedings “before the trial court shall remain stayed during the pendency of this petition.” The matter has been adjourned to July 28.
