HC issues notice to Haryana over plea seeking quashing of action of DGP

The petitioner's counsel submitted that as per the practice and the procedure prescribed, whenever any IG is promoted to the post of ADGP, then along with his promotion orders, the posting orders are also issued by the state

The Punjab and Haryana High Court has issued a notice to Haryana government over a petition seeking quashing of the action of DGP, Haryana, whereby an Inspector General of Police (IGP) – who was promoted as Additional Director General of Police – has been allowed to continue on the post of IGP, South Range, Rewari, Haryana, and discharge duties as IGP as well without any orders and authority in this regard.

The petitioner in the case is Navneet Kaur, who through her counsels – Pardeep Solath, Satbir Mor and Sarveesha Sharma – contended that though Matta Ravi Kiran (who was holding the post of IGP, South Range, Rewari, Haryana) has been promoted to an ADGP rank officer, no orders of his new posting have been issued by the government till date. But despite the promotion, he is still discharging duties as IGP, South Range, Rewari, Haryana, the counsel argued.

The petitioner’s counsel submitted that as per the practice and the procedure prescribed, whenever any IG is promoted to the post of ADGP, then along with his promotion orders, the posting orders are also issued by the state. In some cases, the posting orders are issued later. It was told to the high court that Matta Ravi Kiran was posted as IGP, the orders of which were issued by the state. And since then, Matta Ravi Kiran has been holding the post of IGP, South Range, Rewari, Haryana.

The Haryana government vide order May 20, 2022, promoted Matta Ravi Kiran and three other IPS officers to the rank of ADGP.

The petitioner’s counsel further argued that despite the promotion, Matta Ravi Kiran is not only holding the post of IGP, South Range, Rewari, Haryana, but also is discharging several duties, making financial withdrawals from the state exchequer and issuing administrative as well as quasi-judicial orders. All such orders and directions issued by Matta Ravi Kiran are void ab initio and without any authority.

Such orders have no legal sanctity and are nothing but abuse of the powers, alleged the petitioner’s counsel.

It was contended that on the one hand, the Haryana government has declared the post of IGP, South Range, Rewari, vacant as per the latest gradation list by the state, on the other, Matta Ravi Kiran is allowed to hold the post without any orders and authority.
