Sabarmati jailbreak bid: No more police remand for accused,says HC

The Gujarat High Court Friday rejected a petition by the state government seeking further remand of five of the accused in the 2008 Ahmedabad serial blasts case in connection with their alleged complicity in the failed attempt to escape from the Sabarmati Central Jail through a tunnel in February this year.

The state government had sought their remand for nine more days.

The five accused are Zahid Shaikh,Hafiz Mulla,Sibli Abdul Karim,Daduli Abdul Karim and Nasir Patel.

After their arrest in the case by the Ahmedabad’s City Detection of Crime Branch (DCB) on February 27,the five were sent to police custody for five days.

Subsequently,they were transferred to jail. On March 8,DCB sought their remand for nine more days.

However,the magisterial court and sessions court refused to grant their further custody to DCB following which the state government approached the HC.

Counsel for the accused,M M Shaikh,said the court rejected the state government’s plea on the ground that the accused were already sent to police remand for five days and to judicial custody. Also,Shaikh added,a Supreme Court judgment had said an accused could not be sent to police custody after 15 days of his arrest in a particular case.

Cong demands CBI probe

The Congress on Friday demanded a CBI probe into the Rajkot incident and sought the arrest of the two BJP councillors named by one of the deceased in his dying declaration,besides that of state BJP general secretary Vijay Rupani. State Congress president Arjun Modhwadia told reporters that the BJP leaders were backing land mafia involved in getting the house of Nepalis vacated.
