Naroda ‘attempt to murder’: HC asks top cops to reply to petition by June 27

Petitioner alleged JCP interfered with probe to shield the accused,who are his relatives

The Gujarat High Court (HC) on Wednesday ordered Ahmedabad Police Commissioner S K Saikia and Joint Commissioner of Police Siddhrajsinh Bhati to reply to a petition that alleged Bhati has been interfering with the investigation of an attempt-to-murder case to shield the accused who happen to be his relatives. The court has asked the two policemen,along with the state government,to file an affidavit in this regard by June 27 when the matter is set for further hearing.

The petitioner has been identified as Jayendrasinh Rajput. In his petition,Rajput said he registered an FIR on June 7 with Naroda Police Station. In the FIR,he alleged that Dharmendra Barad and Vanraj Barad,along with an unidentified person,had attacked him and one of his friends in Naroda on that day. His friend had sustained serious injuries with multiple fractures and 72 stitches.

Police had registered the FIR,but they did not arrest the accused even after they visited the police station after the FIR was registered. Rajput alleged that the accused were the relatives of Bhati and,therefore,he had been interfering with the investigation to shield the accused.

Rajput said he made a representation in this regard to the Police Commissioner on June 10 to no avail. Ultimately,he moved the petition before HC seeking to transfer the investigation of the case from Naroda Police Station to Police Commissioner himself.

The petition was heard by Justice S R Brahmbhatt. The court orally observed it would not tolerate any interference with the police investigation.

Subsequently,the court issued notice to all the respondents to the petition – the state of Gujarat,Ahmedabad Police Commissioner and Naroda Police Station. The petitioner had not joined Bhati as a respondent to the petition. However,the court ordered to join him as a respondent to the petition and also issued him a notice to file an affidavit by June 27.
