The Rajkot City Police has initiated a probe against a constable after a murder accused was found inebriated when he was taken back to Rajkot Central Jail after being produced before a local court on July 24.
The jail staff noticed smell emanating from accused Avesh Audiya’s mouth during frisking after the constable, Paresh Vaghela, brought him back to jail. After the medical officer of the jail concluded that Audiya had consumed liquor, V K Pardhi, in charge jailor of Rajkot Central Jail, filed a complaint against him and the constable.
Following this, cases were lodged under Section 223 (disobedience to orders promulgated by a public servant) of BNS, and the Gujarat Prohibition Act.
Jagdish Bangarwa, Deputy Commissioner of Police (Zone II) of Rajkot city, said, “We have recorded the statement of the undertrial in connection to the Prohibition Act case. The constable has been booked for disobeying orders, as according to a Home department notification, an undertrial is deemed to be in custody of policemen escorting him to and from court… and during such period, policemen are not supposed to allow him to eat or drink any contraband.”
A senior police officer at Rajkot City Police headquarters, to which the constable is attached, said, “Appropriate action will be taken against the constable based on the findings of the inquiry.”
