Ishrat Jahan encounter: HC summons CBI

The Gujarat High Court issued a notice to CBI,asking it to remain present before the court in connection with the Ishrat Jahan encounter case.

The Gujarat High Court on Friday issued a notice to the Central Bureau of Investigation (CBI),asking it to remain present before the court in connection with the Ishrat Jahan encounter case.

The notice was issued on a petition filed by Ishrat’s mother,Shamima Kausar,demanding transfer of investigation into the case from Ahmedabad City Detection of Crime Branch (DCB) to the CBI. Justice Kalpesh Jhaveri fixed July 17 as the date for next hearing.

According to the details of the case,Ishrat,along with three others,was killed in an alleged encounter by the DCB near Kotarpur Waterworks in Ahmedabad on June 15,2004. The three others killed in the encounter were identified as Javed Gulam Shaikh alias Pranesh Kumar Pillai,Amjad Ali alias Rajkumar Akbar Ali Rana and Jisan Johar Abdul Gani.

The DCB had claimed that all the four had links with Pakistan-based terrorist outfit,Lashkar-e-Toiba,and that they were on a mission to assassinate Chief Minister Narendra Modi.

Following the encounter,Shamima had filed a petition in high court,seeking transfer of the case to the CBI.

Shamima’s counsel,Shilpa Shah said,“The CBI has been asked to remain present in the court because we have demanded transfer of the case investigation to Central agency.”

He added that the court has also asked DCB officials to produce the case papers before the court.

The issuance of the notice comes after the Supreme Court recently directed the high court to complete the proceedings on the petition in six months,on request of M R Gopinath Pillai,the father of one of the persons killed in the encounter.

He had moved the apex court with a prayer to order fresh probe into the encounter.

But the SC asked him to join as a party in Shamima’s petition after Gujarat government contended that similar petition is pending before the high court.
