The state government on Wednesday opposed the induction of any Central probe agency officer in the Special Investigation Team (SIT) constituted by the Gujarat High Court to investigate the 2004 Ishrat Jahan encounter case,if the court decides to reconstitute the Team.
Advocate General Kamal Trivedi made submissions to this effect in the HC while opposing two petitions to hand over the investigation to CBI.
Trivedi argued that when the SIT consisting of Gujarat-cadre officers has already been given the task of investigating the matter,induction of any Central officer is not necessary at all,more so when the SIT was constituted with the consent of all the parties concerned.
In an affidavit opposing the same,the government criticised the Centre for changing its stand on the issue following a report submitted by Metropolitan Magistrate S P Tamang.
Earlier,the Centre had opposed a CBI probe. Now,it has shown its preparedness to hand over the case to CBI.
Assistant Solicitor General P S Champaneri said the Centre has no objection if the case is transferred to CBI or the SIT is reconstituted by including a Central agency officer.
Earlier,while hearing the petitions seeking a CBI probe,a Division Bench comprising justices Jayant Patel and Abhilasha Kumari had indicated that it may re-constitute
the SIT.
