Defamation case: Fresh summons against Kejriwal, AAP MP on remarks over Modi’s degree

According to Patel, Kejriwal made such defamatory utterances at a press conference on April 1 and Singh made such utterances at a second press conference on April 2.

A magistrate court Tuesday issued a fresh summons to Delhi Chief Minister and Aam Aadmi Party (AAP) national convener Arvind Kejriwal and AAP Rajya Sabha MP Sanjay Singh to appear before it on June 7 in a criminal defamation complaint against their remarks about Prime Minister Narendra Modi’s degree.

Additional Chief Metropolitan Magistrate SJ Panchal instructed that the summons be issued along with a copy of the complaint alleging defamation after it came the court’s notice that the summons issued on April 15 was yet to be dispensed with. The summons were initially ordered to be issued by then additional magistrate Jayeshbhai Limbabhai Patel, who has since been transferred.

The defamation complaint was moved by Gujarat University registrar Piyush Patel, who has alleged Kejriwal of defamation citing his statements such as: “If PM studied from Delhi University, Gujarat University, then Gujarat University should celebrate that their alumnus has become the Prime Minister and yet they are trying to hide,” “Degree is not being shown because maybe the degree is fake, forfeited,” “If the degree is there and it is real, then why is it not being given?”

Patel has alleged defamation against Singh’s statements: “Prime Minister is putting his all to prove a fake degree as right”. The complaint stated that the statement was spoken before the media and broadcast through Twitter with the intention of damaging the reputation of the varsity, despite knowing that such utterances will be defamatory.

According to Patel, Kejriwal made such defamatory utterances at a press conference on April 1 and Singh made such utterances at a second press conference on April 2. The two AAP leaders made the remarks after the Gujarat High Court set aside an order of the Central Information Commission (CIC) that had directed the varsity to “search for information” regarding Prime Minister Narendra Modi’s degrees, Patel alleged. The court had then also ordered Kejriwal to pay Rs 25,000 on March 31.
