Convicted for selling cow meat, Surat man, son sent to 7 years in prison

The court Monday refused to consider defence lawyer IS Waiji's submission that Ayub is an asthma patient. The convicts were taken into police custody after the conviction and were sent to the Surat District Central jail later in the evening.

A father-son duo has been sentenced to seven years in prison after a Surat court convicted them for their alleged involvement in selling cow meat.

“Both the accused were selling cow meat in an open area and they don’t have any fear of the law. Their acts promote slaughtering of cows. The act committed by both accused cannot be treated lightly. The court finds that an example is to be set up in the society to stop such illegal activities of cow slaughter,” said Surat Sixth Additional Chief Judicial Magistrate D N Thaker in his order.
The convicted, identified as Ayub Shaikh (53) and his son Atik Shaikh (25), are both residents of Habib Shah Street at Nanpura in Surat.

The case pertains to a case registered by the Athwalines police on May 25, 2017 after the Forensic Science Laboratory report confirmed that the sample of meat seized from the duo was cow meat. The cops had seized 80 kilograms of cow meat worth Rs 8,500 from their possession.

The accused were charged under IPC Act sections 429 (mischief by killing or maiming cattle, etc, of any value or any animal of the value of fifty rupees), 114 (abettor present when the offence is committed) and the Gujarat Animal Preservation (Amendment) Act. 2011 section 6(a) (1) (prohibition against the transportation of specified animals for slaughter), 6(b) (prohibition of selling or buying beef or beef products) and Gujarat Animal Preservation (Amendment) Act 2017 section 8 (penalties), 6 (b), 1 ,2 (No persons shall directly or indirectly sell, keep, store, transport, offer or expose for sell or buy beef or beef products in any form.)

Ayub and his son were arrested on May 25 and released on bail on June 5, 2017.

Defense lawyer Waiji said he would move a higher court against the order in the coming days.
