Saif Ali Khan attack case | Police oppose bail plea: Piece of metal removed from actor’s back from same knife recovered from accused

The court is likely to hear the bail plea on April 9.

The Mumbai police told a sessions court on Friday that the piece of metal removed from actor Saif Ali Khan’s back is from the same knife recovered from the man who allegedly entered his house and attacked him on January 16.

This was part of the response filed by the Bandra police to the bail application of 30-year-old Shariful Islam, who is alleged to be a Bangladeshi national.

While opposing bail to him, the police have said that a broken knife was recovered at the instance of Islam, and its piece was found stuck into 54-year-old Khan’s back, which was removed after surgery and another piece was also found at the actor’s Bandra residence.

“A chemical analysis report has been received from the Directorate of Forensic Science Laboratories, Kalina, Mumbai. The report states that the knife blade fragment found at the scene of the incident, the partially broken knife recovered from the accused, and the knife blade fragment found in the body of the injured Saif Ali Khan are parts of the same knife,” the response filed by the police states.

Islam had filed for bail last week through lawyers Vipul Dushing and Ajay Gawali, claiming that he was falsely implicated. Islam was arrested on January 19 from Thane. He is booked on charges including section 311 (robbery or dacoity with attempt to cause death or grievous hurt), 312 (attempt to commit robbery or dacoity when armed with deadly weapon) 331(4) (punishment for house breaking) of the Bhartiya Nyaya Sanhita along with sections of the Passport Act and Foreigners Act, for allegedly illegally entering India and residing here. He faces a maximum of life imprisonment.

On January 16, the Bandra police had registered a First Information Report (FIR) against an unknown intruder who entered the residence of Khan and his wife actor Kareena Kapoor. After a staff member at the house saw the intruder and raised an alarm, Khan came out of his room and questioned the man. The actor was then allegedly attacked with a hexa blade, and suffered injuries on his hand, neck and back.

While Khan was rushed to the hospital where he underwent surgery to remove a piece of the knife lodged in his back, the intruder managed to escape.

The Mumbai police arrested Islam from Thane on January 19 after tracking him using CCTV footage and other technical evidence.

The police opposed bail to Islam also on the grounds that if released, he may escape and will not be available for the trial. A chargesheet is yet to be filed against Islam. The police submitted in their reply that the forensic science laboratory has also submitted its reports on fingerprints, facial recognition from CCTV footage and DNA test of the accused as well as reports on the blood samples of Khan and two other house staffers who had suffered injuries.

The police in its reply filed through state prosecutor D M Lade also said that proof of Islam being a Bangladeshi national were found in his phone, including voting card and character certificate were found. It was also found that Islam sent a part of his monthly earnings to his family in Bangladesh.

The chargesheet to be filed by the Bandra police will also have details of the Call Data Records of the accused, the place where he purchased the hexa blade, medical treatment reports from the hospital where Khan was treated and details of the identification parade, where the witnesses identified the accused.
