A division bench of the Lucknow bench of the Allahabad High Court has disposed of appeals filed against an order passed by a single bench last year, while directing that a revised select list be prepared of 69,000 assistant teachers selected through the Assistant Teachers Recruitment Examination (ATRE) 2019, rectifying the irregularities committed in fixing the quota for their appointment.
The court has set aside the selection lists issued in June 2020 and January 2022, which included 6,800 candidates.
A division bench, comprising Justice A R Masoodi and Justice Brijraj Singh, directed the state government or the authorities concerned to prepare a select list of 69,000 candidates for appointment as assistant teachers on the basis of ATRE-19 as per Appendix – 1 to the Service Rules, 1981 afresh, ignoring the select lists dated 01.06.2020 and 05.01.2022. The court also directed to carry out exercise within three months.
The court directed that while preparing the new selection list, any adverse impact on the currently working assistant teachers should be mitigated by allowing them to complete the ongoing academic session. This is intended to prevent disruption in the students’ education, it said.
The bench also revised the earlier order and said reserved category candidates who qualify for the general category merit list should be migrated to that category.
In addition, the benefit of vertical reservation should also be extended to horizontal reservation categories, it said.
The division bench passed the order while hearing a bunch of special appeals filed against the order of single bench of the High Court in March last year. The latest order was uploaded on the court’s website on Friday.
While disposing of the special appeals, the court said in its order, “We are conscious of the fact that the learned Single Judge has already quashed the select list of candidates dated 05.01.2022 vide impugned judgment.”
In a statement issued on Friday, the state government said that the basic education department is studying the court order and that “no injustice would be done to any youth’s future”.
