AIMPLB to take legal route to check court interference

The issue is likely to be taken up during the meeting of board’s nine-member sub-committee constituted to take up such issues on court’s decisions.

The All India Muslim Personal Law Board (AIMPLB) has sought legal remedy within the provisions of the Constitution to safeguard court’s interference on issues related to Muslim Personal Law.

The issue is likely to be taken up during the meeting of board’s nine-member sub-committee constituted to take up such issues on court’s decisions. The meeting will be held at Islamic seminary Nadwatul Uloom in Lucknow Saturday. “ We have recently witnessed several decisions by courts which are direct interference on Muslims’ personal laws. We feel there should be a way out for such decisions. The panel will take up legal solutions to avoid differences,” S Q R Ilyas,member,working committee,AIMPLB said,adding the issue was also taken up during the working committee meeting of AIMPLB held in October in Delhi.

If both parties are Muslims,they are governed by Shariat Application Act,1937 on issues related to marriage and property rights. AIMPLB favours settlement of issues related to Muslim Personal Law through Darul Qaza (Shariah Courts) set up in several cities. However,it does not stop anyone from approaching civil court for redressal.
