After London-based forensic expert Andre Semikhodski questioned the methods used to evaluate DNA samples in the Aarushi-Hemraj double murder case,the counsel for Rajesh and Nupur Talwar has moved an application requesting a Ghaziabad sessions court to recall forensic scientist of CFSL,Dr B K Mahapatra.
Rajesh and Nupur Talwar are standing trial for the murder of their 14-year-old daughter Aarushi and domestic aide Hemraj on May 15-16,2008.
The counsel for the Talwars said,We have moved an application for Dr Mahapatra to be recalled before the court. There needs to be further explanation on how he arrived at certain facts. The application will come up before the court of Additional Sessions Judge Shyam Lal on Monday and arguments will be heard. The court will then take a view on whether to summon Dr Mahapatra again.
Semikhodski,a defence witness who has now returned to England,had told the court,In none of his reports Dr Mahapatra has mentioned analysis or results of DNA profiling of reference samples taken from victims and other suspects. This makes it impossible to put his findings within the frame of the current criminal case.
Semikhodski had also said,Since these exhibits have been touched by several persons on several occasion without gloves,during investigation,transportation and proceedings in the court,it would not be advisable to conduct DNA analysis. The results may be misleading and can implicate innocent persons,thus,causing miscarriage of justice.
