Shimla DM orders FIR against coaching centre found conducting classes despite closure orders

The inspection team prepared a detailed interim report, including photographs, video recordings, and other evidence.

Shimla District Magistrate-cum-Deputy Commissioner Anupam Kashyap ordered an FIR against a private coaching institute in Sanjauli for violating Disaster Management Act, 2005. The District Magistrate (DM) earlier issued orders on September 3 and 4, 2025, mandating closure of all educational and coaching institutions in the district.

“The district administration was alerted through social media that the Akash Coaching Center was running classes in violation of disaster management norms. Subsequently, the DM deputed ADM Pankaj Sharma and Tehsildar Apoorv Sharma to inspect the location. The team reached the centre at 10:10 am on Saturday and found classes in progress. During inspection, messages promoting online classes were found on students’ mobile phones,” a spokesperson said.

“When the onsite operation head, Rajesh Kumar, was asked, he claimed that classes were being conducted only for students residing within the institute’s premises and hostel. However, upon questioning the students, it was found that many were not staying inside the campus or hostel,” the spokesperson added.

The inspection team prepared a detailed interim report, including photographs, video recordings, and other evidence, and submitted it to Kashyap. Acting swiftly, the DM directed the SP to register an FIR. The team also inspected another coaching centre in Sanjauli, which was found to be closed.

Later, the DM said that the administration received information that classes were being conducted at Akash Coaching Center despite the disaster management orders.

“Upon inspection led by the ADM, we found ongoing classes. Sections 51, 52, and 53 of the Disaster Management Act, 2005 were violated. Accordingly, FIR registration has been directed. If any other institution is found violating the orders, strict action will be taken. We urge the public to report such violations immediately,” Kashyap added.

“Section 51 – Penalty for Obstruction: Any person who obstructs or resists any officer or employee of the central or state government, or any authorised authority under this Act, in the discharge of duties, or refuses to comply with directions issued by the authorities, can be punished with imprisonment for up to one year, or a fine, or both. If obstruction results in loss of life or imminent danger to life, imprisonment can extend to two years. Section 52 – Penalty for False Claims: Anyone who knowingly makes false claims to obtain relief, assistance, repairs, reconstruction, or other benefits from the government or authorised agencies during a disaster is punishable with imprisonment for up to two years and a fine. Section 53 – Penalty for Misappropriation of Funds or Material: Anyone who misuses funds or materials intended for disaster relief, or coerces others to misuse such resources, is punishable with imprisonment for up to two years and a fine,” the DM said.
