Irked over the delay in arrest of Inspector Gurmukh Singh of Punjab Police,who is allegedly involved in a case of custodial death,the Punjab and Haryana High Court has directed the Punjab Police to arrest the inspector or face the music.
A division bench comprising Chief Justice Mukul Mudgal and Justice Ranjan Gogoi on Thursday made it clear that if the inspector was not arrested in connection with the case,the inspector general of police of the concerned range would have to file an explanation on account of the failure of the police. The state police have been given four weeks to file their response and arrest the inspector. On the last date of hearing,the Central Bureau of Investigation (CBI) was issued notices by the High Court expressing its anguish over the inaction on the part of the state machinery against its own police officer.
In September 2009,consumption of organophosphorus had killed a man named Roor Singh in police custody at Dhilwan,a town in Kapurthala district. The counsel for the family of Roor Singh,and senior lawyer Sanjeev Sharma,the amicus curiae,had raised questions on the inquiry that the inspector general of police (crime) had conducted into the case.
In an affidavit filed in the High Court,Balbir Singh,Deputy Superintendent of Police,Bholath,Kapurthala,had informed the court that Manjit Singh,Munshi Head Constable (MHC),and Gurnam Singh,Assistant MHC,had been arrested on October 10; and Kulwinder Singh Thiara,Superintendent of Police,head quarters,Kapurthala,had conducted raids to arrest Inspector Gurmukh Singh and Assistant Sub-inspector Ajit Singh.
Gurmukh and Ajit are still on the run. In the inquiry report,the IGP had sought directions to the Kapurthala SSP for the arrest of all four policemen on duty at Dhilwan during the suicide of Roor Singh. Balbir couldnt explain how Roor Singh could find the poisonous substance in police custody. In order to initiate proceedings,three written requests were made to the area magistrate for an arrest warrant against Inspector Gurmukh Singh and Assistant Sub-inspector Ajit Singh.
