KFC delivers chicken burger to vegetarian woman, directed to pay her Rs 12,000

Rs 7,000 as compensation for causing mental agony and harassment; Rs 5,000 towards cost of litigation.

The District Consumer Disputes Redressal Commission of Chandigarh has directed the manager of KFC, Sector 35, here to pay Rs 12,000 to a city resident for delivering a non-veg burger instead of a veg burger.

Anirudh Gupta of Chandigarh stated that he and his wife are regular customers of KFC, but his wife is a hardcore vegetarian. Gupta alleged on May 3, 2023, he ordered a chicken bucket for himself and one a classic veg krisper for his wife on KFC’s online app and made a UPI payment of Rs 696.59.

Gupta alleged, “When my wife took the first bite of the burger delivered to us, she experienced something unfamiliar. She immediately called me and showed me the burger. I was shocked to find that the burger had chicken. Since my wife is a pure vegetarian, she immediately started vomiting.”

The complainant alleged that due to the negligent act of the KFC manager, his wife was in a mental dilemma and under immense stress.

The KFC manager in reply submitted, “The complaint has been filed on false and frivolous grounds with malafide intention and ulterior motive to extort money from KFC and defame the brand. The complainant concealed that the order placed was a takeaway order which was collected by the person after checking the same on the premises.

Moreover, before the collection of any order by any customer of KFC whenever any order is placed online on the KFC website, it always sends a message on the mobile number which was mentioned by its customer while placing any order to KFC wherein in the said message an online link is sent to the said customer to check the description of the order placed by said respective customer.”

It was submitted by KFC that “all vegetarian food sold by KFC has a symbol of a green circle inside a square with a green outline, prominently displayed on the package, contrasting against the background on the principal display panel whereas in any non-vegetarian food (any food which contains whole or part of any animal including birds, marine animals, eggs, or products of any animal origin as an ingredient, excluding honey, milk or milk product must have a symbol of a brown colour filled triangle inside a square with a brown outline prominently displayed on the package contrasting against the background on the principal display panel”.

The Commission on perusing the receipts of the order held that “it clearly indicates that the KFC outlet instead of delivering a veg krisper burger as mentioned in the receipts, delivered a non-veg krisper burger stuffed with chicken which is fairly apparent from the pictures of the burger and same amounts to clear cut deficiency in service and negligence on the part of the KFC manager, especially when the manager has miserably failed to rebut the evidence led by complainant by way of any cogent documentary evidence”.

From the foregoing discussion, one thing is clear the KFC manager was negligent while rendering service to the complainant and wrongly delivered a non-veg food item to the wife of the complainant who is a pure vegetarian thereby hurting her sentiments which caused a lot of mental agony and stress to her, the Commission observed.
The Commission ordered the KFC manager to pay “Rs 7,000 to the complainants as compensation for causing mental agony and harassment to him and his wife and to pay an amount of Rs 5,000 towards costs of litigation”.
