The Punjab and Haryana High Court has directed the residents of Kalka to remove all remaining encroachment on the Kalka- Shimla Highway by May 17. Though the residents said all encroachments have already been removed,the claim was disputed by the National Highway Authority of India (NHAI).
Anil Kumar Dahiya,Project Director,NHAI,submitted in the court on Friday that there were encroachments that were yet to be removed.
In the first instance,we consider it just and appropriate to allow petitioners two days time to remove any remaining encroachment, the Bench ruled. The court,however,said if the order is not implemented by May 17,then the NHAI officials will make arrangements to remove the encroachment by May 22.
The Bench also said that encroachment beyond the drain and towards the road should be removed immediately by the NHAI. If any resident,the Bench said,claims that property beyond the drain and towards the shops is not an encroachment,then he will have to prove the same and move an application under Section 23 (3) of Control of National Highway. It will be decided by the Project Director. All encroachments have to be removed by May 29,the court held.
