The state government on Tuesday defended states Fisheries Minister Purushottam Solanki who has filed a petition challenging Governor Kamla Beniwals decision to grant sanction to prosecute him in a Rs 400-crore fishing scam.
During a hearing in the case in the Gujarat High Court today,government pleader Prakash Jani argued that the Governors decision was unconstitutional.
However,complainant Ishaq Maradias lawyer Mukul Sinha demanded that the government file an affidavit before the court declaring its stand on Solankis prosecution.
Jani replied the government had already informed the court that the decision by council of ministers was appropriate.
Advocate Prakash Thakkar,who is representing Solanki in the case,cited a Supreme Court ruling that the Governor could only exercise her extraordinary powers in case of a law and order problem or a situation that threatens the democratic setup. He said the Governor did not have powers to constitute a parallel inquiry.
