The Central Bureau of Investigation (CBI) has approached the Supreme Court to transfer Tulsiram Prajapati encounter case from Ahmedabad to Mumbai. It has been more than eight months since SC in its order had stated that this encounter case be clubbed with Sohrabuddin Sheikh encounter case. In September 2012,SC had transferred the trial of the Sohrabuddin encounter to Mumbai,where the case is under trial before a special CBI court.
In April this year,while staying further action against BJP leader and former Minister of State for Home Amit Shah in Tulsiram encounter case,the Supreme Court had ruled that Tulsi encounter was a part of Sohrabuddin encounter case and,therefore,it should be clubbed and be heard together. Shah is a key accused in both the cases.
Earlier,the CBI filed its chargesheet in September 2012 in Tulsiram encounter case against Shah,along with 19 policemen,including the then DGP P C Pande,retired IPS O P Mathur,ADGP Geetha Johri and suspended IPS officers D G Vanzara,Rajkumar Pandian,Dinesh M N and Vipul Aggarwal. Apart from Shah,Vanzara,Pandian,Dinesh are also key accused in the Sohrabuddin encounter case. They were shifted to Navi Mumbais Taloja jail.
About two months back,CBI had approached the special CBI court in Ahmedabad,requesting to transfer the case to Mumbai. However,the court rejected it,saying that ordering the transfer doesnt fall under its jurisdiction and it would not initiate it unless it gets proper order from the concerned authorities.
Therefore,we have approached the Supreme Court to pass an appropriate order in this regard. The matter hasnt come on board,but we are expecting it soon, said CBIs senior counsel Ejaz Khan.
Many accused policemen,including Vanzara,Pandian and Dinesh,who were shifted to Taloja jail in Mumbai,were being brought to Ahmedabad before the CBI court to mark their presence every 14th day in the Tulsiram case. They were,however,taken back to Mumbai after the hearings. About two months back,the CBI court here ordered not to bring them here unless required.
