As the Patna High Court Thursday set aside Bihar government’s move to raise reservation in jobs and educational institutions to 65 per cent, Rashtriya Janata Dal (RJD) leader Tejashwi Yadav on Thursday questioned the silence of Chief Minister Nitish Kumar on the matter.
Accusing the BJP of trying to put an end to reservation, Yadav said: “I am aghast at the judgement. The BJP had been trying to scuttle the caste survey, which provided the basis of hiked quotas. It is no surprise that such a verdict has come within days of the party’s return to power at the Centre,” he said. “I don’t understand why the CM is silent on this,” Yadav rued.
Yadav said he would write to the CM, suggesting him to lead an all-party delegation to meet Prime Minister Narendra Modi and seek remedial measures. “As far as legal remedy is concerned, the RJD will move the Supreme Court against the high court order if the state government fails to rise to the occasion,” said the RJD leader, who was serving as the deputy CM when the Bihar government released the report of the caste survey, pointing at a rise in the population of SCs, STs, OBCs and extremely backward classes.

On November 7, 2023, the then Nitish Kumar-led Mahagathbandhan government had raised the Bihar quota slab to 65 per cent. With this, reservation in the state effectively became 75 per cent when the 10 per cent quota for economically weaker sections (EWS) is taken into consideration.
A division bench of HC Chief Justice K Vinod Chandan and Justice Harish Kumar set aside the government’s notifications, saying that it is “infringing upon right to equality”. This came after a petition by Nalanda resident Rakesh Kumar and others.
