HC relief for man convicted of murder

Bombay High Court (HC) has quashed a judgment of a lower court,which had awarded life sentence to a man in 2008 for killing his brother with a sickle over property dispute.

Bombay High Court (HC) has quashed a judgment of a lower court,which had awarded life sentence to a man in 2008 for killing his brother with a sickle over property dispute.

The High Court,however,held appellant Haridas Mahale guilty of culpable homicide not amounting to murder and sentenced him to eight years’ imprisonment.

Justices P D Kode and Vijaya Tahilramani took into account the version of Lila,sister-in-law of Haridas. Lila told the court that on April 30,2006,Haridas,her husband Mohan and his father came home for lunch. Lila heard Mohan tell Haridas that he would not give him any share from their property,she told the court.

Haridas then fetched a sickle and assaulted Mohan,she said. Mohan died in hospital later.

Haridas was arrested and on July 30,2008,the Nashik sessions court convicted him of murder.
