Gujarat riots: Supreme Court to hear Zakia plea on November 26

Appearing for the SIT, senior counsel Mukul Rohatgi said the matter had already been decided by the trial court and HC. He also questioned social activist Teesta Setalvad being a co-petitioner.

The Supreme Court on Monday adjourned till November 26 the hearing on a plea by Zakia Jafri, wife of slain Congress leader Ehsan Jafri, challenging the decision of a Gujarat court to accept the report of the Special Investigation Team (SIT) that gave a clean chit to leaders including the then Chief Minister Narendra Modi in the 2002 post-Godhra riots.

Jafri’s Special Leave Petition (SLP) came up before a bench of Justices A M Khanwilkar and Deepak Gupta, which fixed the new date to hear it. Appearing for the SIT, senior counsel Mukul Rohatgi said the matter had already been decided by the trial court and HC. He also questioned social activist Teesta Setalvad being a co-petitioner. The court asked how that could be and said it would look into the matter.

Jafri challenged the October 5, 2017, judgment of the Gujarat High Court upholding the order of a magistrate accepting the closure report filed by the Supreme Court-appointed SIT to probe the violence during the riots. She contended that the High Court order which came on her revision plea was “erroneous”.
