JEE Main 2023: Bombay High Court to hear plea on 75% eligibility criteria today

Meanwhile, the NTA is today starting the second session 2 of the JEE Main 2023 exams, which is scheduled on April 6, 8, 10, 11 and 12.

JEE Main 2023: The Bombay High Court today (April 6) heard the plea for the removal of JEE Main 75 per cent eligibility criterion. Through this plea, the petitioner has requested the National testing Agency (NTA) to remove the 75 per cent eligibility criterion for this attempt.

“The marks scored by them is not a true reflection of their actual ability therefore those students with less marks than the eligibility criteria (75%) for this year’s examinations can score very high marks in the upcoming JEE Main 2023, and if a fair chance is denied to them that will affect the future (of) lakhs of bright (students),” the PIL stated.

However, the Bench of Acting CJ SV Gangapurwala and J. Sandeep V. Marne has now asked the NTA to file additional documents. “File an affidavit to this and the intervention application,” the Bombay High Court told NTA, according to LiveLaw.

“The Bombay High Court has asked the government to submit some documents pertaining to 75 per cent criteria, such as since when is it applicable and top 20 percentile how it’s going to help if different states have different top 20 percentile,” Anubha Srivastava told indianexpress.com. “The next hearing for JEE 75 per cent eligibility plea will be on Wednesday (April 12) or Thursday (April 13). Govt counsel will inform after confirming with AG as he will be appearing,” she added.

Earlier, the petition had also requested a deferment of the January session of the Joint Entrance Examination (JEE) Main 2023. However, the Court rejected that plea and the hearing on the removal of the 75 per cent eligibility criterion was scheduled for April 6.

While the eligibility criterion was removed in the Covid years, in the 2023 JEE brochure, the IITs brought back the eligibility criteria of 75 per cent marks in Class 12 board exams for admission to NITs, IIITs, and CFTIs. The brochure stated that the candidates should have secured at least 75 per cent in their Class 12 board exams (for the general category), or should be within the category-wise top 20 percentile of successful candidates of their respective boards.

Another JEE matter stuck in the Delhi High Court is the plea of relaxation of “two attempts in two consecutive years” for students who did not appear for JEE Advanced twice, or even once in 2021 and 2022 — due to Covid. The Delhi High Court had earlier heard the plea and had asked the respondents to file their response. Candidates claimed that they faced technical issues and were unable to reach their exam centres on time due to last-minute changes in the exam centre, due to which they were unable to appear for the exam.

However, the Union Education Ministry on Monday said that it is not considering any proposal for a one-time relaxation in criteria.

“After due verification, the affected candidates were allowed to appear in re-examinations held on June 29, 2022 (Shift-2) and June 30, 2022 (Shift-1) for Session-1 and on July 30, 2022 (Shift-1) for Session-2. Moreover, the candidates who have passed the Class 12 or equivalent examination in 2021, 2022, or appearing in 2023 can appear in JEE (Main) – 2023 examination.

“For the school leaving batch of 2020, the JEE (Main) examination was conducted two times in 2020, four times in 2021 and two times in 2022 giving them sufficient opportunities to take the JEE(Main) examination,” Union Minister of State for Education Subhas Sarkar informed Lok Sabha in a written response.

Meanwhile, the NTA is today starting the second session 2 of the JEE Main 2023 exams. The engineering entrance exam will be conducted on April 6, 8, 10, 11 and 12. The reserve dates for the JEE Main are April 13 and 15.
