The Uddhav Thackeray-led Shiv Sena’s application to summon Election Commission officials during the ongoing hearing of disqualification petitions of MLAs from both the Sena factions was rejected by Assembly Speaker Rahul Narwekar, who said the move would further cause delay in adjudicating the petition.
The Sena wanted the EC officials to be called to verify the Sena’s original constitution after Chief Minister Eknath Shinde-led Shiv Sena claimed that the Sena UBT submitted forged and fabricated documents including the undivided Sena’s constitution.
Shinde-led Sena, however, termed the move by Sena UBT as their delaying tactics and effort to divert the attention from the misconduct of Sena UBT during the disqualification hearing.
Asim Sarode, lawyer representing Sena UBT, said Narwekar said that EC has to be called in if it has to be decided which constitution is the original constitution of Sena and that the SC as well as EC has accepted Sena’s 2018 constitution. “Only the EC can decide which constitution is acceptable in terms of justice. The Shinde faction claimed that there are fake documents and that the constitution submitted to the EC was different. But the 2018 constitution given to the EC has been accepted by both factions in the Supreme Court. There is no question of delay, but of justice. The Sena UBT said the party will not press for this demand to avoid delays,” Sarode said.
