Observing that the trial is in progress and no ground is made for grant of bail, a special court on Thursday rejected the bail applications of two accused booked in the 1993 Bombay blasts case.
The court rejected bail pleas of Munaf Hakari and Mohammed Shoeb Qureshi. The third phase of the trial against seven accused is underway.
“Already, 16 witnesses have been examined and 25 to 30 witnesses remain to be examined. No change in circumstances has been shown by the applicant since the rejection of his earlier bail application. Thus, looking at the gravity and seriousness of the crime, the role attributed to the applicant, and the fact that he was absconding for the past 27–28 years, no case is made out for releasing him on bail,” special judge V D Kedar said in the order, rejecting bail to Halari. Against Qureshi, too, the court said he had been absconding for nearly 28 years and is facing a separate trial in Gujarat.
The case relates to the 12 bomb explosions which had taken place in Mumbai on March 12, 1993, killing 257 and leaving 713 injured. Two sets of accused have faced two separate trials earlier. Since the seven were arrested subsequently, they are currently facing a separate trial.
Halari in his plea filed through lawyers Ayush Pasbola and Rohin Chauhan had submitted that his earlier bail plea was rejected in 2021, and he had withdrawn his appeal before the Supreme Court in 2024, with liberty granted to him to file a fresh plea after six months before the trial court. They submitted that the first witness was examined on October 7, 2024, and a year later only 13 witnesses are examined, submitting that the trial may not conclude in the near future so the bail plea can be considered on grounds of delay.
