Rahul Gandhi citizenship case: Delhi HC directs Centre to seek instruction on status of Subramanian Swamy’s complaints

Swamy has contended in his petition that on August 6, 2019, he had written to the Ministry of Home Affairs (MHA) on Gandhi’s voluntary disclosure of his British citizenship and said that Gandhi could not hold both British and Indian citizenship. The MHA had issued notice to Gandhi on Swamy’s complaint. However, Swamy contends that despite repeated representations made to the MHA asking for an update and the status of his complaint, no action has been taken or intimated to him to date.

Earlier, in November 2024, the Delhi High Court had expressed its concern that adjudicating Swamy’s plea may lead to “two parallel proceedings” over the same issue, as another plea by a BJP worker from Bengaluru, Vignesh Shishir, challenging Gandhi’s alleged dual citizenship and seeking a CBI probe into the matter, was pending before the Allahabad High Court.

In December 2024, the Delhi High Court had sought the Centre’s position on Swamy’s petition, seeking the court’s directions to the MHA on the matter.
