There is some relief in sight for the allottees of Commonwealth Games Village flats. The Delhi Urban Art Commission (DUAC) has found the project acceptable from the point of view of aesthetic quality of urban and environmental design. But the commission has made it clear that issuing completion certificate for the complex should be separately dealt by the competent authority.
According to minutes of the meeting held on December 14,the commission received a letter from Secretary,Ministry of Urban Development,on the subject of completion plans for the Games Village wherein the Secretary (UD) has suggested revisiting the position keeping in view the framework of Section 11(1) of the DUAC Act 1973 and send DUAC comments as a general policy issue.
The commission reconsidered the proposal and the commission finds the proposal acceptable as per provisions of Section 11(1) of the DUAC Act 1973 from the point of view of aesthetic quality of urban and environmental design. The Commission,however,reiterates the observations made earlier as far as regulatory aspects are concerned,which need to be dealt separately by the competent authority, state the minutes of the meeting.
The DUAC,at its meetings held on August 10 and 24,2011,had not scrutinised the proposal of issuing a conditional completion certificate for the Games Village flats and had returned the same to the Delhi Development Authority (DDA),since the latter had not given due certification with regard to conformity of the proposal to the master plan or building bylaws and other regulatory provisions.
The commission has also asked the DDA to first sort out the matter concerning the excess floor-area ratio (FAR) as the overall FAR of the Village is more than the compoundable limit of 5 per cent as per provisions of Delhi Master Plan-2021.
Meanwhile,DDA sources claimed that the Ministry had now asked the land agency to look into issuing the completion certificate for the Commonwealth Games Village complex as soon as possible. We are presently examining the matter keeping all legalities in mind, said a source.
The matter is likely to come up for hearing in the Delhi High Court on January 19. The court had slammed the Ministry of Urban Development for its indifferent attitude and lethargy in resolving disputes related to irregularities in the Commonwealth Games Village complex. It has directed the Ministry to hold deliberations with the Group of Ministers (GoM) expeditiously and try to have its decision known by January.
The court had also deemed it necessary that in the eventuality of the GoM deciding that the deviations were non-compoundable,warranting demolition in the complex,65 flats equivalent to 12841.35 square metres of excess built-up area should be identified and kept aside as an interim measure.
