In a major relief for Padmashree awardee Anjolie Ela Menon, the Punjab and Haryana High Court on Friday allowed her petition wherein she had challenged the proposed acquisition of her land in Haryana. Menon had alleged that her land was being acquired to facilitate a housing project in the garb of laying down a road.
Menon had contended the claim that the land was being acquired for a 60-m wide Sector road, east of Ghatta bundh. However, the real motive, according to her, behind acquisition was evident from the ongoing construction, and advertisement for sale of the large private luxury housing project. The Sector road, which was proposed to be 60-m wide, had no apparent purpose, apart from serving as a secondary access for the luxury development, the petitioner had alleged.
Menon had moved the high court earlier as well; and had partially succeeded in obtaining relief through the quashing of a Section 6 declaration dated July 14,2008. However, she was forced to approach the court against a fresh declaration under Section 6 of the Land Acquisition Act.
