Two years after two police officers allegedly harassed a man and seized his scooter in Delhi’s Naraina, the Patiala House Court on September 4 directed the Naraina SHO to file an FIR against the officers involved. Sources said that action is likely to be taken against the then SHO as well for his alleged inaction.
“In view of the seriousness of allegations, contradictions between the Action Taken Report (ATR) and video evidence, and the necessity for a professional investigation, application under Section 156(3) CrPC is allowed. The SHO, PS Naraina, is directed to register an FIR forthwith under appropriate sections of law, including Section 384/506(partI)/ 120B IPC on the basis of the complaint and to conduct a fair and impartial investigation,” Judicial Magistrate Ankit Garg stated in the order.

According to the complainant, on November 2, 2023, he was on his scooter when he was intercepted by two officers near a gurdwara in Naraina. He alleged that the policemen, who were in an inebriated state, demanded Rs 2,000 from him. Upon his refusal, they allegedly abused and threatened him before forcibly taking his scooter by snatching the keys. He also claimed that one of the officers drove off in the said vehicle, adding that no action was taken despite making a PCR call.
When he reached Naraina police station the next day, he was allegedly harassed and the scooter was also not released. The man also raised this issue with senior police officers and the Lieutenant Governor.
In response to an application for the release of his scooter, police had stated that it was “found unclaimed” and deposited in the malkhana.
However, taking into consideration the video purportedly recorded by the man of the officer driving his scooter away, the court has said, ““The evidence filed, including the video clip, raises grave suspicion over the police version and shows that custodial powers may have been abused. A detailed investigation is necessary to secure CCTV footage, call detail records, and examine the chain of custody of the scooter.”
