— Article 163 of the Constitution of India provides for Council of Ministers to aid and advise Governor. The Ministers shall hold office during the pleasure of the Governor. Hence, statement 3 is correct.

— There shall be a Council of Ministers with the Chief Minister at the head to aid and advise the Governor in the exercise of his functions, except in so far as he is by or under this Constitution required to exercise his functions or any of them in his discretion.

— The Supreme Court ruled that governors acting in their statutory capacity as University Chancellor are not bound by the council of ministers’ aid and advice. Hence, statement 2 is not correct.

— The judgment read: “Rule of law requires that a statutory power vests in the body or authority where the statute so provides, and likewise, the discharge of the statutory duty is the responsibility of the body or authority to which it is entrusted. That body or authority cannot merely rubber-stamp an action taken elsewhere or simply endorse or ratify the decision of someone else.”

— On (December 3) Sunday, votes were supposed to be counted for new Assemblies in five states — Madhya Pradesh, Rajasthan, Chhattisgarh, Telangana, and Mizoram.

— Later, the Election Commission of India (ECI) announced a change of plan: counting of votes for the Mizoram Assembly had been delayed by a day, and would now be held on Monday, December 4.

— The election schedule includes all dates from the date of issue of gazette notification to the date before which the election process shall be completed.

— According to Sections 14 and 15 respectively of the Representation of the People Act, 1951, the ECI can notify elections at any time within six months of the end of the term of Lok Sabha or a state Assembly. Hence, statement 1 is correct.

— The election process has to be completed before the expiration of the existing term of Lok Sabha or the state Assembly.

— While deciding the election schedule, the ECI looks at the availability and requirements for the movement of security forces, the logistics of arranging electronic voting machines (EVMs) and poll officials, as well as major national and local festivals, and the prevailing law and order situation. Hence, statement 2 is not correct.

— If the terms of several state assemblies end at the same time, the ECI attempts to keep the elections together. While polling may take place on different days, voting is usually done on the same day.

— A party may gain or lose national party status from time to time, depending on the fulfilment of these laid-down conditions.

(i) It is ‘recognised’ in four or more states; or Hence, 1 is not correct.

4. (c)

FYI:

— Article 39-A of Constitution of India provides for Equal justice and free legal aid.

— The State shall ensure that the operation of the legal system promotes justice on an equal opportunity basis, and shall, in particular, provide free legal aid, through appropriate legislation or schemes or in any other manner, to ensure that opportunities for securing justice are not denied to any citizen due to economic or other disabilities.

Therefore, option (c) is the correct answer.

5. (a)

FYI:

— Article 102 deals with the disqualification of MPs from either house of the Parliament. A person shall be disqualified for being chosen as, and for being, a member of either House of Parliament —

(a) if he holds any office of profit under the Government of India or the Government of any State, other than an office declared by Parliament by law not to disqualify its holder; Hence, statement 1 is correct.

(b) if he is of unsound mind and stands so declared by a competent court; Hence, statement 2 is not correct.

(c) if he is an undischarged insolvent;

(d) if he is not a citizen of India, or has voluntarily acquired the citizenship of a foreign State, or is under any acknowledgment of allegiance or adherence to a foreign State; Hence, statement 3 is not correct.

(e) if he is so disqualified by or under any law made by Parliament.”

— A person shall be disqualified for being a member of either House of Parliament if he is so disqualified under the Tenth Schedule.
