A chief judicial magistrate, Ahmedabad district court, on Monday dismissed a petition seeking action against Prime Minister Narendra Modi for breach of model code of conduct during the last year’s Lok Sabha election in April. The court dismissed the petition filed by a former member of Aam Adami Party (AAP).
SR Singh, chief judicial magistrate, Ahmedabad district court, while rejecting the petition ordered, “This court is of the opinion that there is no material substance against the accused to proceed with the case and therefore the present proceedings of the case should be dropped…”
Former member of AAP Nishant Varma had first approached Ranip police station for lodging an FIR under Section 130 of the Representation of People Act (RPA) and sections 114 and 171 (c) of the Indian Penal Code (IPC). After the police officials refused, he moved the court.
Earlier, an investigation into a similar complaint was conducted by Detection of Crime Branch, Ahmedabad last year following an FIR lodged with it by the order of Election Commission. The DCB investigation gave a clean chit to Modi . On Monday, the magisterial court upheld the order while dismissing Varma’s complaint.
