Suspended TMC MP Kunal Ghosh granted interim bail in Saradha case

The bench said that the accused cannot be denied bail for any longer because the case started by CBI under sections 420 120B and 409 under the IPC was being heard at a Magistrate Court.

After being behind bars for nearly three years, one of the main accused in the multi-crore Saradha scam and expelled Trinamool Rajya Sabha MP Kunal Ghosh was on Wednesday granted an interim bail till November 11.

A division bench of Justice Asim Kumar Ray and Justice Malay Marut Banerjee of the Calcutta High Court granted him the bail against a personal bond of Rs 2 lakh.

There had been, however, certain conditions laid down by the court regarding Ghosh’s bail. He will have to submit his passport to the CBI, cannot leave the jurisdiction of Narkeldanga Police Station where his residence is and will not only have to appear before the CBI once a week but will also have to cooperate whenever CBI officials want to interrogate him.

Ghosh had been arrested by the Bidhannagar City Police on November 23, 2013 but the CBI had officially taken the custody of Ghosh on November 6, 2014. In October last year, he had gone on an indefinite hunger strike from the correctional home. He had even attempted to commit suicide by consuming sleeping pills.

After the hearing yesterday, bench said that the accused cannot be denied bail for any longer because the case started by CBI under sections 420 120B and 409 under the IPC was being heard at a Magistrate Court where the CJM can give a highest imprisonment of three years. The court observed that under these circumstances the accused cannot be kept under CBI custody for more than half the tenure of maximum imprisonment and in this case he has already served more than that.
