Noting that police failed to thoroughly investigate a case,in which a 16-year-old girl died months after she eloped with a man from a different religion,a city court directed the Commissioner of Police to get the matter investigated by a sensitised branch of Delhi Police.
Additional Sessions Judge Kamini Lau acquitted the girls husband of charges of rape and murder,but convicted him of kidnapping her since she was 16 when he married her.
The girl eloped with Monu in September 2010. She died under suspicious circumstances at a hospital in March 2011. Her family had lodged a case of kidnapping,rape and murder against her husband. Police claimed that Monu had taken her away without the permission of her parents,married her,gave her slow poison and abandoned her.
The court found several discrepancies in the testimony of the girls parents and evidence collected by police. It said the girls parents admitted that she informed them about the marriage and the police had tried to divert the investigations and downplay the unnatural death.
The court observed that the conduct of the parents was suspicious,but police had not looked at the possibility of the death being a case of honour killing,especially since the family of the girl had stated that they did not approve of the relationship.
The behaviour of the parents of the prosecutrix of giving incorrect history,delaying her treatment is highly suspicious and the possibility of the girl having been poisoned by her own family… cannot be ruled out, the court said.
The court directed police to file a report within three months.
