Tribunal awards Rs 17.47 lakh in compensation to family of youth killed in tipper accident

Crash caused by rash and negligent driving; three people had died in the incident

Nine months after a road accident claimed the life of a 20-year-old youth, the Motor Accident Claims Tribunal (MACT) has ordered a compensation of Rs 17.47 lakh with 7.5% annual interest to the victim’s family.

The tribunal ruled in favour of Mamtesh, mother of deceased Kuldeep, a resident of Bhagwanpura, Barwala, Panchkula district. The compensation amount is to be paid jointly by tipper owner Amit Sobti, driver Balwinder Singh, and insurer United India Insurance Company Ltd.

Although the victim’s mother had filed a petition seeking Rs 80 lakh in compensation, the tribunal determined Rs 17.47 lakh as the justified amount based on evidence and the deceased’s notional income.

Accident details

According to the case records, the family was returning from a wedding in Mandi village in Muzaffarnagar district, Uttar Pradesh, on February 4, 2025, when the fatal incident occurred. Around 8 pm, as Sukhvir Singh and his family members reached Nagla Mor, his grandchildren Kuldeep, 20, and Palak, 14, began crossing the Handesra–Ambala road.

At that moment, a speeding tipper truck came from the Handesra side with high-beam lights on and driving on the wrong side of the road. The tipper, driven rashly and negligently, hit Kuldeep and Palak, dragging them several metres as their clothes got entangled in the front bumper.

The truck then collided with a motorcycle ridden by Vijender Kumar, another family member standing nearby, causing him severe injuries. While Kuldeep died on the spot, Palak and Vijender Kumar were rushed to hospital. Vijender was declared brought dead, and Palak succumbed to her injuries at PGIMER, Chandigarh, on February 8, 2025.

The driver fled the scene, abandoning the vehicle. Later, an FIR was registered at Handesra police station.

Tribunal’s findings

In its verdict, the tribunal observed that the accident occurred due to the reckless and negligent driving of the tipper driver and that the respondents attempted to conceal material evidence. The court held the driver, vehicle owner, and insurance company jointly liable to pay the compensation.

The judgment described the accident as a clear case of negligence, emphasising that the victims were standing on the correct side of the road when the speeding tipper struck them.

The tribunal concluded that the family is entitled to Rs 17.47 lakh along with 7.5% interest per annum until full payment is made.
