Punjab and Haryana HC disposes of PIL after Municipal Corporation restores Manimajra water pipeline

Court had earlier warned of contempt against commissioner for six-month delay in restoration.

The Punjab and Haryana High Court Friday disposed of a public interest litigation filed by Shivani Sahni, a local resident, after the Chandigarh Municipal Corporation submitted that the main water pipeline connecting Sector 26 to Manimajra had been restored to its original alignment in July 2023.

A division bench of Chief Justice Sheel Nagu and Justice Sanjiv Berry took note of the MC’s compliance report, bringing to an end the PIL that had highlighted the civic body’s prolonged delay in completing the work.

Sahni had moved the court in 2024 stating that the pipeline, originally laid through a causeway, was damaged during heavy rain in July 2023. As an interim measure, it was laid across the narrow Sukhna choe bridge to maintain water supply to Manimajra and adjoining areas. However, this temporary arrangement began obstructing vehicular movement on the bridge, prompting Sahni to serve a legal notice on the authorities in January 2024 before filing the PIL.

In its January 8 order, the bench had criticised the MC for failing to meet its own timeline. An affidavit filed in July 2024 by the civic body’s superintending engineer had promised restoration within a month, yet the work remained unfinished more than six months later. Granting a final extension until March 31, 2025, the court had warned that the commissioner would be held personally liable for contempt if the delay continued.

With MC counsel Sanjiv Ghai confirming that the pipeline was restored to its original position in July 2023, the bench Friday closed the matter, observing that the petitioner’s grievance had been addressed.
