The Punjab and Haryana High Court on Friday slammed the Haryana government for making selective arrests in a case,where an unruly mob had damaged public property in Hisar during a rally on Jat reservation. A criminal case was also registered against the then Hisar SP Subhash Yadav. During the resumed hearing of the case,the court raised an eyebrow over the manner in which the Haryana Police had investigated the case.
Producing two lists of FIRs,the police stated that while eight accused have been arrested,95 were booked.
The first list makes an interesting reading. FIR at serial number 1 discloses commission of offences bailable in nature and triable by the judicial magistrate. Of the eight people booked,five have been arrested. Three persons repeatedly named in rest of the FIRs are also stated to have been arrested, a Division Bench comprising Justices M M Kumar and T P S Mann said.
The order added: … However,none of accused,despite being identified have been arrested for reasons known best to state. It shows that at one stage or other,the process of selective arrest has been followed,where in fact,there was hardly any room to spare such persons from process of law.
The court has summoned the report prepared by the Special Investigation Team,constituted by the Haryana Police,to investigate the case. ENS
