Weeks after the Vadodara city police arrested three persons in connection with the August 26 case of eggs being allegedly hurled at a Ganesh procession in the old city area of Panigate, Mujahid Nafees, Convener of the Minority Coordination Committee (MCC) Gujarat, has served a legal notice to the Chief Secretary, Additional Chief Secretary (Home), Gujarat Director General of Police and Vadodara Commissioner of Police, said sources on Friday. The notice alleges
“custodial torture and public parading” of the accused.
The legal notice seeks prompt investigation and monitoring mechanisms for “remedial, disciplinary, punitive, and criminal measures against the erring officials”.
Nafees has demanded action against the police officials responsible, citing violations of Article 21 of the Constitution of India.
Nafees said, “…the conduct of the police constitutes not only a violation of Article 21 of the Constitution of India but also a clear contempt of the Hon’ble Supreme Court’s landmark judgment in DK Basu vs State of West Bengal [1997] 1 SCC 416, which sets out binding guidelines to prevent custodial torture.”
“The incident, widely reported on 27 August 2025, revealed that all the victims belonged to the minority Muslim community. Despite extensive media coverage, no action has yet been initiated, amounting to a grave violation of fundamental rights and a dereliction of duty by authorities entrusted with maintaining law and order,” he said.
