THE GUJARAT High Court has directed the Regional Passport Officer to process the application of an Indian national from Gujarat, working in Kuwait, whose passport renewal process was put on hold due to an FIR related to rash and negligent driving registered against him in Mahisagar district.

In an oral order on Tuesday, Justice Aniruddha P Mayee directed that the authorities must process the petitioner’s renewal application within four weeks, considering the submissions of the petitioner that he “would face forceful deportation and permanent blacklisting which would put his livelihood at stake.”

The order of the HC, uploaded Wednesday, states, “In the peculiar facts and circumstances of the present case and considering the nature of offence as mentioned in the FIR, the court is inclined to direct the respondent to process the passport application… within a period of four weeks on its own merits and in accordance with law in view of the written explanation … submitted before the authorities. The present order is also passed keeping in view the fact that the petitioner is working in Kuwait and would have to face serious consequences if the renewal of the passport is not considered.”

The court considered submissions of the petitioner that a “suitable written explanation had been given to the Embassy of India at Kuwait” on September 7 regarding the FIR lodged against him and had also undertaken “to remain present and fully cooperate with the learned trial court for expeditious disposal of such criminal proceedings.”

The order of the court also noted that the petitioner was not aware of the FIR filed against him by the police authorities as the complainant is a Police Head Constable. The HC was hearing a plea filed by an NRI from Gujarat, challenging an order that withheld the passport application of the petitioner as an explanation was sought from the petitioner regarding the ‘suppression of offence’ of rash driving or riding on public way, registered at the Lunawada police station.
