The breakdown of panchayat system or customary courts and gradual erosion of the institution of family were responsible for the huge backlog of cases in Indian courts, said Justice M R Shah of the Gujarat High Court on Saturday.
Justice Shah was addressing judicial officers and senior advocates in the city after inaugurating the new building of Alternative Dispute Resolution Centre of Rajkot, along with Justice Harsha Devani, administrative judge of the HC.

Justice Shah said that instead of resolving disputes locally, people had started to move the courts. “Why did the need for mediation arise? It was there earlier also. The panch would assemble and take decisions. Disputes would be resolved within families. But the sense of being a family has faded gradually and we have started going to courts. Due to this, burden on the courts has increased,” he said.
Justice Shah said clearing the pending cases was a daunting task. “There is another reason for the increased burden on courts — people have complete faith in the judiciary.”
