Supreme Court Strikes Down Key Waqf Clause, Refuses to Halt Entire Law | Waqf Amendment Act

SC On Waqf Board: The Supreme Court on Monday declined to stay the Waqf (Amendment) Act, 2025, but suspended its most contentious clause requiring a person to be a practising Muslim for five years to create a waqf. Chief Justice B.R. Gavai said the law’s registration mandate wasn’t new but warned the five-year clause risked “arbitrary exercise of power” without proper rules. The court also stayed provisions allowing officers to flag Waqf–government land disputes but permitted limited non-Muslim representation on Waqf Boards.
