The face-off between Uttar Pradesh Governor TV Rajeswar, and Chief Minister Mulayam Singh Yadav continues.

In yet another gubernatorial snub, Rajeswar last week returned Yadav’s request to approve the appointment of retired Justice MA Khan as Chief Information Officer, under the newly-passed Right to Information Act, 2005, introduced to curb corruption among public servants. The Governor has asked Yadav to reconsider his choice.

Khan has been in the spotlight since November 2004, when he dismissed the writ petition filed by BSP legislator, Swami Prasad Maurya, against the 40 BSP MLAs who had defected to the Samajwadi Party to bring Yadav to power. Khan’s dismissal of the petition a year later had taken even the other judge of the two-judge bench, Justice Jagdish Bhalla, completely by surprise, as the latter had reserved his judgment in the case.

Within a week of the decision, Khan retired from service. Barely three months into retirement, Khan got the appointment from the state.
