Maharashtra court issues summons to Fadnavis in 2014 poll affidavit case

The SC had ordered a fresh trial in the case on a petition by Nagpur based lawyer Satish Uke , who had argued that Fadanvis had failed to mention two criminal cases in his 2014 affidavit and hence his election be declared invalid.

A local Maharashtra court Monday issued summons to Chief Minister Devendra Fadnavis on a plea alleging non-disclosure of two criminal cases by him in the 2014 election affidavit.

The Judicial Magistrate First Class (JMFC) court has asked Fadnavis to remain present in the court on December 4 for hearing in the case, which has been re-registered following a Supreme Court directive on October 1.

The SC had ordered a fresh trial in the case on a petition by Nagpur based lawyer Satish Uke , who had argued that Fadanvis had failed to mention two criminal cases in his 2014 affidavit and hence his election be declared invalid.

Uke had moved the court in 2015 against non submission of the two criminal cases by Fadanvis in his affidavit but his plea was rejected.

He later moved the Sessions court that had set aside the JMFC court’s order saying it was “cryptic and non- speaking”. Fadnavis had then moved the High Court against this order, which set aside the Sessions court’s order.

The Supreme Court later upheld Uke’s plea directing re- run of Fadnavis’ trial in a JMFC court. Uke has also petitioned the State Governor seeking to prevent Fadanvis from taking oath as Chief Minister. He has also alleged threat to his life from the CM.
