Defence Ministry has decided to file a Special Leave Petition (SLP) in the Supreme Court against an Armed Forces Tribunal (AFT) order asking it to reserve two posts of Corps Commanders for Lieutenant Generals P G Kamath and J S Bajwa.
Appearing on behalf of the Defence Ministry,lawyer Anjana Gosain contended before the Principal Bench of AFT that the Defence Ministry had decided to file a fresh appeal in the SC against the order and sought time for it.
In the first week of July,the Ministry had withdrawn the SLP it had filed in the Supreme Court maintaining that it would like to appeal to the AFT for modifications,which was rejected by the Tribunal.
Lt Gens Bajwa and Kamath had filed a case before the Tribunal for being appointed as Corps Commanders,for which they were cleared by an Army selection board but were not given the charge as they did not have the required residual three years of service.
They have claimed that though they were rejected for the post of Corps Commanders,three other officers were given relaxation in the residual service clause.
The ministry is also planning to refute the claims made by two officers who had named Lt Gen Chetinder Singh,N K Singh and present 15 Corps Commander Lt Gen S A Hasnain as the beneficiaries of the relaxation given to them by the ministry.
Bajwa is at present the Chief of Staff at the Kolkata- based Eastern Command while Kamath is holding the same office at the Central Command in Lucknow.
