Plea seeking narco test on Amit Shah withdrawn

The complainant in the alleged Sohrabuddin Shaikh and Tulsiram Prajapati fake encounter case, in which BJP president Amit Shah is a prime accused, Tuesday withdrew his application seeking narco analysis tests on Shah and 37 other accused in the case.

The sessions court had earlier observed that, if on Tuesday the Bombay High Court takes no action based on a letter written by the complainant, Sohrabuddin’s younger brother Rubbabuddin, the special CBI court would proceed with the trial.

Rubabuddin had urged the High Court to reverse the transfer order of the judge earlier presiding over the CBI court. The CBI court had stayed the proceedings in the trial for almost a month, as Rubabuddin had sought time.

Rubabuddin, however, informed the court that there have been no orders from the High Court, following which the court posted the case for hearing to September 9.

The court Tuesday exempted Shah from remaining present in court following another exemption application filed by Shah’s lawyer on the grounds of “political work”. Judge B H Loya observed that so far Shah had been exempted from 17 hearings in the trial. The judge, however, said that none of accused should remain absent from the court proceedings without stating sufficient reasons.
