Court rejects Chudasama’s plea to stay put in Gujarat jail

A special CBI court hearing the 2005 Sohrabuddin encounter case has rejected Gujarat IPS officer Abhay Chudasama’s plea seeking to allow him to remain lodged in a jail in his state.

The court also dismissed as “lame” excuse the ground cited by Chudasama that pothole-ridden roads in Mumbai posed a problem for him since he had undergone a hip-joint surgery.

While other accused Gujarat Police officers have been transferred to Thane’s Taloja jail,Chudasama continues to be in Nadiad jail in Gujarat.

His lawyer Rizwan Merchant had argued that the police officer was not in a condition to undertake long-distance travel because of bad roads in Mumbai.

While the application was rejected on August 6,a detailed order was prepared by the court on Monday.

In the 20-page order,special CBI judge J T Utpat has observed that the superintendent of Nadiad jail had refused to obey the court’s order of shifting Chudasama to Mumbai for trial. “On CBI’s request,the superintendent of Nadiad jail was directed to shift Chudasama to Mumbai to produce him before the court,but he refused to obey the order contending that the accused was undergoing treatment and opinion of the doctor was necessary,” Jugde Utpat has observed in the order.

The court also observed that if Chudasama could travel from Nadiad to Ahmedabad for his treatment,he could travel in Mumbai as well.

The court has also asked the state authorities to ensure that proper security cover is provided to IPS officer Abhay Chudasama in Mumbai.
