The Supreme Court on Friday said that it is for the Centre to decide the claim of an institution seeking a minority status. This comes amid reports about the government’s plans to oppose the minority status of Aligarh Muslim University and Jamia Millia Islamia in New Delhi.
“The power to grant minority status to an institute entirely vests with the central government, which may decide it based on relevant materials,” said a five-judge Constitution Bench presided over by Chief Justice T S Thakur.

Citing the relevant provisions of the National Commission for Minorities Educational Institutes Act 2004, the bench held that an institution will have to approach the Central government with adequate materials to get a minority status, and the competent authority can then pass appropriate orders.
The court said this while deciding a petition filed by Bramho Samaj Educational Society seeking minority status for its educational institutions. The bench asked the organisation to approach the Centre within six weeks with its plea . It asked the Minorities Affairs Ministry to decide the plea within one year.
