In the growing list of celebrities seeking to protect their personality rights, Bollywood actor Shilpa Shetty Kundra has approached the Bombay High Court. Shetty has sought to protect and safeguard her personality/publicity rights, including her name, voice, image, likeness, signature, and all other attributes which are distinctive and exclusively associated with her.
Celebrities, including Aishwarya Rai, Amitabh Bachchan, Hrithik Roshan, and Karan Johar, have approached courts against unauthorised or unlicensed use or commercial exploitation by third parties.
Naming various businesses based in Mumbai, Bengaluru, Surat, and New Delhi, along with Artificial Intelligence companies and social media platforms as defendants, the petition states that Shetty’s personality rights have been violated.
“The defendants by generating or reproducing videos and images containing the Plaintiff’s performance, name, image, likeness or caricature in a manner that brings disrepute to the plaintiff (Shetty) and makes her the subject of unsavoury humour, constituting a violation of the moral rights vested in her performance,” the petition filed through lawyer Sana Raees Khan says.
In her plea, Shetty states that the use of AI to clone her voice, vocal style and technique, and morphed and digitally manipulated images, deepfakes, in videos, posters, diaries, books and other merchandise, generates revenues for the defendants while violating her moral rights.
The petition says that Shetty has established ‘exceptional goodwill’ through her career spanning several decades, while also promoting causes related to mental health, yoga, environmental sustainability, and child welfare on social media.
Against some of the defendants, Shetty has sought an order restraining the use of her images and other attributes for passing off goods and services as being endorsed by her. She has also sought Rs 5 lakh in damages from some of the named defendants.
She has also sought that all such content that infringes her rights be ordered to be taken down, removed, or blocked.
