A 49-year-old man was sentenced to ten years of imprisonment by a special court in Mumbai for sexual assault of a 16-year-old boy in 2021.
The crime came to light after three months when photographs taken by the accused on his phone during the act were circulated in the vicinity by him and reached the victim’s mother. The court found the accused guilty under sections of the Protection of Children from Sexual Offences (Pocso) Act.
According to submissions made by special public prosecutor Jyoti Sawant before the court, in 2021, classes of the minor boy were online due to the Covid-19 pandemic. Usually after finishing his classes, he would play cricket on the ground near his house.
On the day of the incident, the accused approached him and asked him to accompany him. When the boy refused, the accused bit him and took him to an isolated spot, where he sexually assaulted him. He also took photographs of the act on his phone.
The boy did not disclose the incident due to the threats given by the accused that he would kill his sister. A few months later, the accused circulated the photographs of the assault through his phone and his mother was shown the photos by a neighbour.
Following this, she asked the boy about it, and he told her about the assault. The Mumbai police arrested the accused after receiving a complaint.
During the trial, the boy and his mother deposed about the incident. The accused claimed he was falsely implicated for refusing to give the boy money to buy a bat. The court considered the statements and medical evidence even as the police failed to show the photographs as evidence.
“Pocso Act is enacted to protect children from sexual offences with the aim of securing proper development of children and to protect their childhood against exploitation. In order to deter the accused and society from commission of any offence against a child, it is necessary to punish the accused under the Pocso Act,” the court said. It also directed the accused to pay a fine of Rs 10,000 to the victim.
