Malegaon blast: Two accused file bail pleas, another seeks treatment at Nair Hospital

Two accused in the 2008 Malegaon blast, retired Army Major Ramesh Upadhyay and Rakesh Dhawade, filed fresh bail applications at the city civil and sessions court Monday afternoon. They filed pleas to seek bail before Judge G D Tekale.

The National Investigation Agency (NIA), which chargesheeted 14 people in the case, has time till September 9 to file replies, opposing bail to Upadhyay and Dhawade as well as Colonel Shrikant Purohit and Sadhvi Pragya Singh Thakur who had filed bail pleas earlier.

Another accused, Sameer Kulkarni, filed an application before the court, seeking that he be sent to civic-run Nair Hospital to get treated for a persistent tooth ache. Kulkarni told Judge Tekale that he was not satisfied with the current treatment at J J Hospital and claimed, “J J Hospital does not have the same facilities. When I went there last, my teeth was not examined. Instead, doctors recommended that two of my teeth be extracted.”

Judge Tekale however, ordered Kulkarni not to presume that facilities at J J Hospital were not at par with those at Nair Hospital. “You are a patient not a doctor,” said the judge.”

However, Kulkarni insisted that he be taken to Nair Hospital Saturday, when the out-patient department would not be overcrowded. “How long should I tolerate the pain? When I can change lawyers, why can I not change doctors,” he asked.

Rasal pointed out that Kulkarni had made 13 trips to Nair Hospital in the five years that he had been in judicial custody.
